These Terms and Conditions of Use, referred to indistinctly as the 'Terms and Conditions' and/or 'T&C,' establish the terms and conditions for accessing and using the commercial name "KRIBATTA Wallet," including its mobile applications, websites, programs, computer systems, any applications and/or content (collectively referred to as 'KRIBATTA Wallet'), products, as well as related services, collectively known as the 'Service' and/or the 'Services,' offered and/or provided and/or operated by LWG TRUST SERVICES LIMITED LIABILITY COMPANY, WITH COMPANY NUMBER 3-102-812820, REGISTERED IN THE NATIONAL REGISTRY OF THE REPUBLIC OF COSTA RICA (hereafter referred to as "LWG Trust Services") directly or through third parties. The Terms and Conditions, along with the privacy policy of KRIBATTA Wallet, can be found on the site (www.KRIBATTA.com) and collectively constitute a contract between LWG Trust Services and the user ('User' or 'Users'). This contract outlines the general conditions of access and use through which the User may access and use the Services and/or KRIBATTA WALLET, as well as any products or services available or accessible through KRIBATTA Wallet.

Acceptance of Terms and Conditions

By accepting these terms and conditions, the user consents to the establishment of a fiduciary contract in which LWG Trust Services acts as a fiduciary. This fiduciary contract will be responsible for conducting currency exchanges on behalf of the user, using third-party liquidity providers for this purpose.

When we refer to or use the term 'KRIBATTA Wallet,' we encompass, but are not limited to, all web services, associated pages within or outside of each website or application, content, or any materials provided by LWG Trust Services through KRIBATTA Wallet. This also includes all related devices, applications, or services that KRIBATTA WALLET offers, operates, and/or provides in connection with these terms and conditions.

In these terms and conditions, when we mention the 'User,' we are referring, without limitation, to any individual who accesses, uses, installs, and/or browses the KRIBATTA Wallet, whether infrequently or regularly. This also applies to individuals who use any of the services offered through the KRIBATTA Wallet by LWG Trust Services, including those who register for KRIBATTA Wallet, utilize any information, tools, software, or functionality provided by KRIBATTA Wallet, including but not limited to content and updates.

By accessing, taking any action, browsing, and/or using KRIBATTA Wallet and/or the Services, the User is expressly accepting these terms and conditions, along with the Privacy Policy. The User acknowledges and agrees to be bound by these terms and conditions and the Privacy Policy, committing to comply with them. This commitment applies whether the User accesses as a visitor (browsing the KRIBATTA Wallet without registering or creating an account) or as a customer (by registering with the KRIBATTA Wallet) and/or through any other means.

Thus, prior to engaging in any access, action, browsing, or use of KRIBATTA Wallet or any Service, the User is advised to thoroughly read these terms and conditions and the Privacy Policy. The User should make a free and voluntary decision regarding their agreement with these terms. If the User does not agree to any of these terms or the Privacy Policy, they should refrain from using the KRIBATTA Wallet or the Services in any manner.

Description of Kribatta

Kribatta is a platform that offers services related to digital asset management, including the purchase, sale, and storage of cryptocurrencies, FIAT, and other digital assets. These Terms establish a legal agreement between LWG Trust Services and the user.

General Conditions — Users of the Service

If the User meets the previously established requirements to access the Services and/or Site and decides, of their own free will, to use them, they must proceed to register in KRIBATTA Wallet. By registering and utilizing the Services and/or KRIBATTA Wallet, the Registered User acknowledges and accepts that they have personally conducted the necessary review, diligence, and analysis for such usage.

Upon registration, the User agrees to provide accurate, truthful, and current information. It is the User's responsibility to update this information in the event of any changes from time to time.

Furthermore, upon registration, the Registered User grants LWG Trust Services the authorization, either directly or through third parties, to conduct investigations, consultations, database cross-referencing, and any other actions deemed necessary to verify the User's identity or any data, as outlined in the Privacy Policy. This includes, as a best practice, adherence to current regulations regarding the prevention of money laundering, terrorist financing, protection against fraud, and compliance with other legal requirements.

LWG Trust Services reserves the right to request additional information beyond that provided in the registration form, including fiscal or tax documents, when deemed necessary. Additionally, LWG Trust Services may utilize various means or mechanisms at its disposal to verify the provided information, such as consultation in risk centers, public institution databases, among others. The User acknowledges and accepts this practice and is responsible for the accuracy of the data provided. The User guarantees and takes responsibility, in any case, for the truthfulness, accuracy, validity, and authenticity of the entered personal data. If the provided information cannot be corroborated, the User agrees to the suspension of the Account until the required confirmation information is provided.

The User acknowledges that they are solely responsible for maintaining the confidentiality of the chosen personal security key. Consequently, they bear responsibility for the information and usage of their Account. By registering for KRIBATTA Wallet, the User accepts the responsibility of ensuring the security of any information, identity documents, passwords, or codes used to access the KRIBATTA Wallet. Any negligence or lack of proper diligence on the part of the User regarding the handling of the aforementioned information may lead to unauthorized access to their Account by third parties, as well as the loss or theft of information, resulting in potential damage and/or loss.

The User agrees not to disclose any information, DUIs, passwords, or any code used to access the Site to third parties. LWG Trust Services shall not be held liable for any loss or damage incurred by the User due to unauthorized access by third parties to their Account resulting from hacking or password misplacement, or for any failure to act promptly in response to alerts or notifications sent by KRIBATTA. In the event that the User suspects unauthorized access to their Account information, they must promptly contact KRIBATTA Wallet through our customer service channels.

Account verification, including the authentication of the Registered User, involves the User providing personal information to LWG Trust Services for verification, validation, and confirmation that the individual registering with KRIBATTA Wallet is indeed who they claim to be. In any circumstance, LWG Trust Services reserves the right to request all information deemed pertinent and necessary for the User to operate and/or use any of the Services it provides. The verification of the User's identity will be conducted by LWG Trust Services through mechanisms, methods, and/or authentication factors that comply with the legal and regulatory requirements in these matters, either provided directly by LWG Trust Services or through a third party hired by the company for this purpose.

Kribatta Services

LWG Trust Services provides various services related to digital assets under the commercial name "KRIBATTA." These services include, but are not limited to:

• Buying and selling cryptocurrencies and compatible digital assets.
• Secure storage of digital assets and fiat currency in virtual wallets.
• Transactions and transfers of digital assets and fiat currencies.

Please be aware that the availability of our services may vary depending on your location and is subject to change at any time. KRIBATTA services are exclusively available in connection with supported digital assets listed in the app. We reserve the right to add, remove, or suspend digital assets at any time.

User Responsibility

You are responsible for taking all necessary measures to protect your account and login credentials, including, but not limited to:

• Creating and maintaining a strong password.
• Safeguarding login information, such as passwords and authentication codes.
• Not sharing your login credentials with third parties.

Remember that KRIBATTA will never ask you to share your passwords or authentication codes. If you suspect or detect unauthorized activity on your account, it is imperative to notify us immediately. This ensures that we can take prompt and appropriate action to safeguard your account and digital assets.

Changes to Terms and Services

We reserve the right to modify these Terms at any time. If we make significant changes to these Terms, we will notify you in advance through communication channels we deem appropriate, such as email or announcements on our website. We encourage you to review these Terms regularly. From time to time, it may be necessary to modify or discontinue our services due to legal, regulatory, or technical reasons. We reserve the right to modify or discontinue our services at any time without notice.

Account Termination

You have the right to close your account at any time by following the procedures provided by LWG Trust Services. To close your account, you may be required to complete certain verification steps. The User has the right to terminate this agreement with LWG Trust Services at any time, leading to the closure of the Account once all obligations with LWG Trust Services are fulfilled.

Upon the closure of an Account: (i) The User's right to use the Account for accessing the Services immediately ceases. (ii) Data or content associated with the Account is deleted and disassociated from the User, unless applicable law mandates retention, return, or transmission to the User. (iii) If there is any value in the Account, and the User has not provided an account for withdrawal purposes, the balance will remain blocked until the User completes the withdrawal process.

LWG Trust Services reserves the right to immediately suspend or close all involved Accounts and related Services in the event of unauthorized use of Accounts. The User acknowledges that LWG Trust Services may, without prior notice, limit, suspend, or terminate Services and Accounts, restrict access to the Site, its content, services, and tools, remove stored content, and take technical and legal actions if it believes Users are violating the Terms and Conditions.

Safety & Risk

LWG Trust Services is dedicated to preserving the security of the digital assets under its custody. However, digital assets are susceptible to specific risks, such as market volatility and cybersecurity threats. It is crucial that you comprehend and acknowledge the risks linked to investing in digital assets. LWG Trust Services employs technical and organizational security measures to safeguard your digital assets and personal data, including two-factor authentication, data encryption, and continuous monitoring for security threats. However, we cannot provide an absolute guarantee of complete security.

Exclusion of Liability

LWG Trust Services is not liable for technical errors resulting from force majeure or any damage caused by force majeure. LWG Trust Services does not guarantee uninterrupted data availability and may conduct maintenance tasks for a freely chosen period of time. The User acknowledges and agrees that LWG Trust Services is not responsible for any damage, loss or inconvenience to the User caused by system failures, server issues, internet interruptions or issues within KRIBATTA Wallet.

If LWG Trust Services is unable to deliver the Service described in these T&C of use for KRIBATTA Wallet, due to reasons beyond its control, including but not limited to force majeure events or factors, regulatory changes, changes in law, or penalties, it is not liable to the Users regarding the Service offered under this agreement and for the duration of such event or factor.

Market Risks, Forks and Changes in Digital Assets

You understand and agree that digital assets are subject to price changes and market volatility. Investing in digital assets carries inherent risks, and it is essential for you to conduct your own research and make informed decisions. LWG Trust Services may suspend its services related to digital assets in the event of changes, such as forks of the blockchain. We have no control over the creation or implementation of these changes, and we cannot guarantee their security or functionality.

Governing Law and Jurisdiction

These Terms are governed by the laws of Costa Rica. Any dispute relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of Costa Rica.

Divisibility

If any provision of these Terms is held to be invalid or unenforceable, the remainder of the Terms will remain in effect. Invalid or unenforceable terms will be replaced by provisions that closely align with the original intent of the original provisions.

User Acceptance

You agree and acknowledge that these T&Cs set out the rules of a legal, valid, and binding contract. You declare that you are a person over 18 years of age, possess the legal capacity to contract, own a personal email, and own a personal cell phone number. Therefore, minors, individuals temporarily or permanently unable to contract, or those without an email account or a personal cell phone number will not be able to operate in KRIBATTA Wallet.

The User DECLARES UNDER OATH to comply with Anti-Money Laundering Laws and other applicable legal provisions, swearing that the funds, assets, and other securities, whether used in the past or intended for future transactions, are and will be of lawful origin. The User accepts and declares that he/she will not use his/her Account, nor the KRIBATTA wallet, to engage in illegal or criminal activities of any kind, including money laundering, terrorist financing, financial terrorism, malicious hacking, or violation of provisions outlined in legal regulations.

Finally, the user acknowledges and accepts each of the clauses, conditions, and obligations established in this document and swears to faithfully comply with them. These Terms and Conditions of Use of KRIBATTA Wallet are governed by the laws of Costa Rica.
